The Supreme Court decides today whether Theresa May’s government is entitled to invoke Article 50 of the Lisbon Treaty, kicking off formal negotiations for EU withdrawal, without the Parliament’s approval. The Conservative-led government appealed against a lower court’s decision that Members of Parliament would need to collectively approve the decision, but is expected to be defeated. The UK’s most senior judges are reportedly set to reject it by 7-4, however, so the case is likely to be ripe with important consequences for the future of British constitutional law. With a significant majority of MPs favouring May’s intentions to invoke Article 50 by the end of March, though, Brexit will be firmly on track regardless of what side the judges fall upon.
